1. Agreement to Terms

By accessing or using RedSide Threat Lab ("the Service," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not access or use the Service.

These Terms constitute a legally binding agreement between you and RedSide Threat Lab. Please read them carefully before using our Service.

2. Description of Service

RedSide Threat Lab provides professional malware analysis and threat intelligence services, including:

  • Automated and manual malware analysis
  • Threat intelligence reports with detailed findings
  • Indicators of Compromise (IOCs) extraction
  • Behavioral analysis and network traffic analysis
  • 24-hour Service Level Agreement (SLA) for analysis completion
  • Subscription-based and pay-per-analysis pricing models

3. Eligibility and Account Registration

To use our Service, you must:

  • Be at least 18 years of age
  • Have the legal capacity to enter into binding agreements
  • Provide accurate, current, and complete information during registration
  • Maintain and update your account information as necessary
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized use of your account

You are responsible for all activities that occur under your account, regardless of whether you authorized such activities.

4. Acceptable Use Policy

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Submit files that you do not have legal authority to analyze
  • Use the Service to analyze files for malicious purposes
  • Attempt to reverse engineer, decompile, or disassemble the Service
  • Interfere with or disrupt the Service or servers connected to the Service
  • Use automated systems (bots, scrapers) to access the Service without authorization
  • Impersonate any person or entity or misrepresent your affiliation
  • Violate any applicable laws or regulations
  • Transmit any viruses, malware, or harmful code
  • Collect or harvest information about other users
  • Use the Service in any manner that could damage, disable, or impair the Service

5. File Submissions

When you submit files for analysis:

  • You represent that you have the legal right to submit such files
  • You understand that files may contain malicious code
  • You grant us the right to analyze, process, and store submitted files
  • You acknowledge that analysis results are provided "as-is" for informational purposes
  • You are responsible for ensuring files comply with applicable laws and regulations

Important: Do not submit files containing personally identifiable information (PII) unless necessary for analysis. We are not responsible for PII contained in submitted files.

6. Subscription Plans and Payments

Our Service offers various subscription plans:

  • Basic Plan: Limited analyses per month
  • Professional Plan: Higher analysis limits with priority processing
  • Enterprise Plan: Unlimited analyses with dedicated support
  • Pay-Per-Analysis: One-time payment for individual analyses

Payment Terms:

  • Subscriptions are billed in advance on a monthly or annual basis
  • Payments are processed securely through our payment processors
  • All fees are non-refundable unless required by law or as specified in our refund policy
  • We reserve the right to change pricing with 30 days' notice to existing subscribers
  • Failed payments may result in service suspension

7. Service Level Agreement (SLA)

We commit to completing analysis within 24 hours of file submission, subject to:

  • File size and complexity
  • System availability and capacity
  • Force majeure events

If we fail to meet the SLA, you may be entitled to service credits as specified in your subscription agreement. SLA guarantees do not apply to pay-per-analysis plans unless explicitly stated.

8. Intellectual Property Rights

Our Rights:

  • All content, features, and functionality of the Service are owned by RedSide Threat Lab
  • Analysis reports and methodologies are proprietary to RedSide Threat Lab
  • You may not copy, modify, or distribute any part of the Service without written permission

Your Rights:

  • You retain ownership of files you submit
  • Analysis reports are provided for your use, subject to these Terms
  • You may use reports for your internal security purposes

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • WARRANTIES OF MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OR COMPLETENESS OF ANALYSIS RESULTS

We do not warrant that:

  • The Service will be uninterrupted, secure, or error-free
  • Analysis results will be 100% accurate or complete
  • Defects will be corrected
  • The Service is free of viruses or harmful components

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, REDSIDE THREAT LAB SHALL NOT BE LIABLE FOR:

  • INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES
  • DAMAGES RESULTING FROM USE OR INABILITY TO USE THE SERVICE
  • DAMAGES RESULTING FROM RELIANCE ON ANALYSIS RESULTS

Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.

Security Disclaimer: While we employ industry-standard security measures, we cannot guarantee absolute security. You use the Service at your own risk.

11. Indemnification

You agree to indemnify, defend, and hold harmless RedSide Threat Lab, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Files you submit that violate laws or infringe on rights

12. Termination

By You: You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period.

By Us: We may suspend or terminate your account immediately if:

  • You violate these Terms
  • You engage in fraudulent or illegal activity
  • You fail to pay required fees
  • We are required to do so by law

Upon termination, your right to use the Service will cease immediately. We may delete your account data in accordance with our Privacy Policy.

13. Data Retention and Deletion

We retain your data as described in our Privacy Policy. You may request deletion of your account and associated data at any time. Some data may be retained for legal compliance or security purposes.

14. Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, cyberattacks, or government actions.

15. Dispute Resolution

Governing Law: These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.

Dispute Resolution: Any disputes arising from these Terms or the Service shall be resolved through:

  1. Good faith negotiation
  2. Mediation (if negotiation fails)
  3. Binding arbitration or court proceedings as applicable

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

  • Posting the updated Terms on this page
  • Updating the "Last Updated" date
  • Sending email notification (for significant changes)

Your continued use of the Service after changes constitutes acceptance of the modified Terms. If you do not agree, you must stop using the Service.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and RedSide Threat Lab regarding the Service and supersede all prior agreements and understandings.
